PlayStation®Network: TERMS OF SERVICE AND USER AGREEMENT

PLEASE READ THIS ENTIRE AGREEMENT AND INDICATE WHETHER YOU AGREE TO ITS TERMS BY CLICKING THE "ACCEPT" OR "DO NOT ACCEPT" BUTTON AT THE END OF THE AGREEMENT. YOUR ACCESS TO SONY COMPUTER ENTERTAINMENT'S PLAYSTATION®NETWORK ("PSN") IS EXPRESSLY CONDITIONED UPON YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF YOU CLICK THE "DO NOT ACCEPT" BUTTON, YOU WILL NOT BE ABLE TO ACCESS PSN.

This Agreement is a contract between you and Sony Computer Entertainment Hong Kong Limited ("SCEH") and can be accepted only by an adult 18 years (or 21 years if you are a Singapore resident, or 20 years if you are a Taiwan or Thailand resident) or older. By clicking the "ACCEPT" button yourself, you affirm that you are an adult 18 years (or 21 years if you are a Singapore resident, or 20 years if you are a Taiwan or Thailand resident) or older and that you are accepting and are agreeing to be bound by the terms of this Agreement. You also affirm that you are accepting this Agreement on behalf of, and all legal and financial responsibility and liability for the actions of, the holders of all subordinate accounts ("Sub Accounts") that are attached to your master account. If you are under 18 years (or 21 years if you are a Singapore resident, or 20 years if you are a Taiwan or Thailand resident) you cannot accept this Agreement or open a Master Account. Instead, you must ask your parent or legal guardian to accept this Agreement and to open a Sub Account in your name.

This Agreement applies to services, software and content provided by SCEH through or in connection with PSN, including via the PlayStation®Store and virtual communities, whether delivered onto the PlayStation®3 computer entertainment system, the PSP® (PlayStation®Portable) system, a personal computer or otherwise. Such services, software, and content include subscriptions, data, system software, fixes, updates or newer releases and peripheral materials.

If you accept this Agreement, you are subject to its terms and all other agreements that you have entered into in connection with PSN, as well as any terms and conditions applicable to any product, service or content purchased or accessed by you on or through PSN as notified to you at the time of the purchase and/or access. You also consent to the terms of PlayStation®Network Privacy Policy.

You agree that you will not directly or indirectly use PSN (i) in any way for any commercial purpose, (ii) in any way that violates the law or the community code of conduct, or (iii) in any way that harms Sony Computer Entertainment ("SCE") companies or any of its affiliates, subsidiaries, licensors, providers, partners, and users. You agree that you will not use any unauthorized hardware or software to access or use PSN.

1. PSN ACCOUNT REGISTRATION

PSN gives you the opportunity to participate in SCE's online community, play games online and purchase content and services, such as new levels for your favorite games, as well as game and subscriptions.  PSN may not be available, or may not be supported, in some countries and some languages.  You must create a PSN account in order to access PSN's content and services.  SCEH reserves the right to deny the creation of any account at its discretion and for any reason.  Currently, there are no charges for creating a PSN account, but there may be charges associated with certain online content and/or services that are available through PSN.  All information provided during PSN account registration must be truthful and accurate.  There are two types of PSN accounts:  Master Accounts and Sub Accounts.  All PSN accounts have an associated PSN mailbox for receiving text mail. 

For users with Hong Kong as country / area of residence

If you are 18 years or older, you can create a Master Account for yourself. Each Master Account can create up to six (6) associated Sub Accounts. However, you are not permitted to create Sub Accounts for persons under the age of 18 who are not your children or for whom you are not the legal guardian. A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain communication features. Correspondences from SCEH that relates to a Sub Account's purchases on PSN will be sent to the Sub Account holder and the associated Master Account holder. At its sole discretion, SCEH may send correspondences to the Master Account relating to the Sub Account's other activities on PSN.

A child under the age of 18 can only have a Sub Account associated with a Master Account of the child's parent or legal guardian. You will not be charged a fee for creating a Sub Account. If you are creating a Sub Account for a child under the age of 16, you must provide your consent for SCEH to disclose, pursuant to SCEH's privacy policy, your child's personally identifying information to third parties for the purpose of allowing your child to participate in PSN activities, such as video and voice chat and gameplay. If you do not consent to the disclosure of this requested information, you will not be able to create a Sub Account for the child. If all requested information is provided, a separate email containing a PIN will be sent to the Master Account's email account with instructions to complete registration by entering the PIN into the Sub Account using a personal computer. By participating in PSN community activities and in-game activities, your child may receive communications from adults.

For users with Indonesia or Malaysia as country / area of residence

If you are 18 years or older, you can create a Master Account for yourself. Each Master Account can create up to six (6) associated Sub Accounts. However, you are not permitted to create Sub Accounts for persons under the age of 18 who are not your children or for whom you are not the legal guardian. A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain communication features. Correspondences from SCEH that relates to a Sub Account's purchases on PSN will be sent to the Sub Account holder and the associated Master Account holder. At its sole discretion, SCEH may send correspondences to the Master Account relating to the Sub Account's other activities on PSN.

By participating in PSN community activities and in-game activities, your child may receive communications from adults.

For users with Singapore as country / area of residence

If you are 21 years or older, you can create a Master Account for yourself. Each Master Account can create up to six (6) associated Sub Accounts. However, you are not permitted to create Sub Accounts for persons under the age of 21 who are not your children or for whom you are not the legal guardian. A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain communication features. Correspondences from SCEH that relates to a Sub Account's purchases on PSN will be sent to the Sub Account holder and the associated Master Account holder. At its sole discretion, SCEH may send correspondences to the Master Account relating to the Sub Account's other activities on PSN.

A child under the age of 21 can only have a Sub Account associated with a Master Account of the child's parent or legal guardian. You will not be charged a fee for creating a Sub Account. By participating in PSN community activities and in-game activities, your child may receive communications from adults.

For users with Taiwan as country / area of residence

If you are 20 years or older, you can create a Master Account for yourself. Each Master Account can create up to six (6) associated Sub Accounts. However, you are not permitted to create Sub Accounts for persons under the age of 20 who are not your children or for whom you are not the legal guardian. A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain communication features. Correspondences from SCEH that relates to a Sub Account's purchases on PSN will be sent to the Sub Account holder and the associated Master Account holder. At its sole discretion, SCEH may send correspondences to the Master Account relating to the Sub Account's other activities on PSN.

A child under the age of 20 can only have a Sub Account associated with a Master Account of the child's parent or legal guardian. You will not be charged a fee for creating a Sub Account. If you are creating a Sub Account for a child under the age of 20, you must provide your consent for SCEH to disclose, pursuant to SCEH's privacy policy, your child's personally identifying information to third parties for the purpose of allowing your child to participate in PSN activities, such as video and voice chat and gameplay. If you do not consent to the disclosure of this requested information, you will not be able to create a Sub Account for the child. For users with Thailand as country / area of residence

A Master Account has access to and control over the following aspects of its Sub Accounts: (i) financial aspects; (ii) content availability and (iii) certain communication features. Correspondences from SCEH that relates to a Sub Account's purchases on PSN will be sent to the Sub Account holder and the associated Master Account holder. At its sole discretion, SCEH may send correspondences to the Master Account relating to the Sub Account's other activities on PSN.

A child under the age of 20 can only have a Sub Account associated with a Master Account of the child's parent or legal guardian. You will not be charged a fee for creating a Sub Account. By participating in PSN community activities and in-game activities, your child may receive communications from adults.

Some content and services may not be appropriate for children under a certain age. Please check age ratings for content and services before accessing, downloading or purchasing. Not all content and services are rated. Some content is designed to be downloaded to your PlayStation®3 computer entertainment system or PSP® system and will be accessible by all users of that unit. Please monitor your child's access to content, services and communications that may be age inappropriate. PSN parental controls will not apply to certain materials, including downloaded content and unrated or streamed materials, services and communications. Your child may not be able to access content or play games rated for users older than his or her registered age. In some countries, parents and legal guardians with Master Accounts will be permitted to set their parental controls to override content restrictions on certain materials for associated Sub Accounts. Please see the Online Manual for more information.

You must keep your password secret to prevent unauthorized use of your PSN account. We are not liable for unauthorized use of a PSN account.

Certain information, including your Online ID, any Online ID you create for your associated Sub Accounts, your "About Me" statement, avatar pictures, country / area of residence, preferred language and recently played game titles, will be provided to all PSN users, including children.

2. PSN COMMUNITY

Currently, no purchase is required to participate in general PSN community activities. Feel free to chat via voice and video with friends and enjoy single sign on benefits without purchase, as well as enjoy online entertainment for which there is no subscription or purchase requirement.

3. COMMUNITY CODE OF CONDUCT

As a condition of this Agreement, you must adhere to the following rules of conduct, and also follow a reasonable, common-sense code of conduct. Users are required to take into consideration community standards and refrain from abusive or deceptive conduct, cheating, hacking, or other misuse of PSN. Rights of other players should be respected.

The violations that are prohibited include but are not limited to the following:

Unless otherwise required by applicable law, there is no requirement or expectation that SCEH will monitor or record any online activity on PSN, including communications. However, SCEH reserves the right to monitor and record any online activity on PSN, and you give SCEH your express consent to record all of your activities on PSN. SCEH reserves the right to remove any content from anywhere on PSN at SCEH's sole discretion without notice. SCEH has no liability for any violation of this Agreement by you or holders of any Sub Accounts associated with your Master Account, or by any other player. You agree to indemnify SCEH against any claims or demands made against SCEH in connection with any violation by you or a holder of any Sub Accounts associated with your Master Account of this Agreement, and agree to hold SCEH harmless against any claim or demand that you may have as a result of or in connection with the violation of this Agreement by any other player.

4. CONTENT AND SERVICES ON PSN

PSN provides you with the ability to buy and redeem a variety of content and services, including game-specific items, such as new gameplay levels and graphics, as well as game and subscriptions. All content and services available on PSN are provided by SCEH, including content created or published by third parties. However, we are not responsible for content and services posted, streamed or transmitted by other PSN users. Third parties, including publishers may administer some services, including delivery gameplay or customer service for certain games on SCEH's behalf. To enable third parties to provide such services, we must provide them with your personal information and if you are the Master Account holder, the personal information of the holder of an associated Sub Account. If you do not consent to allow us to share your personal information and the personal information of holders of Sub Accounts associated with your Master Account with third parties for the purpose of providing you with PSN services, you will not be able to participate in PSN. In order to access certain content and services, you may be required to accept additional content-specific terms of service ("Service Agreement"). Notwithstanding any provision of any other agreement, in the event of any conflict between this Agreement and the Service Agreement or any other terms of service in connection with PSN or in connection with any disc-based product used with PSN, this Agreement shall prevail.

In addition, you may be able to set your PlayStation®3 computer entertainment system or other authorized device to automatically download or receive new content from the PlayStation®Store without further notice to you when you sign into PSN. This Agreement shall apply to any such content.

5. WALLET

For some countries, you can buy content and services from the PlayStation®Store and its associated in-game stores by using funds from a PSN online wallet. All purchases made through your Master Account and through Sub Accounts associated with your Account must be made through a PSN wallet set up for your Master Account. A Sub Account does not have its own separate wallet. Master Accounts can set a maximum spending amount for each Sub Account, effective at the beginning of the following month. A Master Account holder can fund the PSN wallet up to a maximum amount determined by SCEH ("Limit"), using either (i) a credit or debit card; (ii) a pre-paid card where available; or (iii) other payment methods as approved by SCEH from time to time. SCEH reserves the right to refuse the purchase of any wallet funds for any reason. Except as otherwise permitted by applicable law or as expressly provided in this Agreement, funds added to the wallet are non-transferable. Wallet funds have no value outside PSN and can only be used to purchase content or services from SCEH. PSN wallet funds that are deemed abandoned or unused by law will not be returned or restored. Funds added to the wallet are non-refundable, except as otherwise permitted by applicable law. A request for refund of PSN Wallet Funds may be made in writing to SCEH at Suites 1501-1506, 15/F, Sun Life Tower, The Gateway, Harbour City, Tsim Sha Tsui, Kowloon, Hong Kong. An administration fee will be charged for any refund application made and processed by SCEH. SCEH is under no obligation to comply with any refund request including in circumstances where the PSN wallet funds are deemed to have been abandoned or unused at law or where the terms of this Agreement have not been complied with. Any refunds will be made by crediting your credit / debit card.

For users with Taiwan as country / area of residence

In accordance with Taiwan Government requirements relating to the issue of receipts for purchase of goods on the Internet, SCEH will cause its affiliated company, Sony Computer Entertainment Taiwan Limited (SCET), to issue a receipt within 10 days from the date of any PSN wallet top up (except for top ups using a pre-paid card). To obtain the receipt by post, please contact SCEH customer services at 0809 079 888 (TAIWAN), within 5 days from the date of PSN wallet top up, to confirm postal address and receipt content. If SCET does not receive a request for postal delivery of the receipt within 5 days from the date of the PSN wallet top up, the receipt will be donated to a charity designated by SCEH without further notice.

6. PREPAID CARDS

Each Master Account and its associated Sub Accounts will be subject to the Limit. If you acquire or purchase a prepaid card that has a value that, when added to the wallet's existing balance, exceeds the Limit, you will not be able to apply the value of the prepaid card to the wallet until sufficient funds have been spent from the wallet to allow the sum of the full value of the prepaid card and wallet to be equal to or less than the Limit. Prepaid cards may be sold by authorized distributors or retailers and are the sole responsibility of authorized distributors and retailers. SCEH is not responsible for, or liable for any claims arising as a result of, any problems encountered using a prepaid card or for any defects in a prepaid card. Please contact the distributor or retailer from whom you purchased your prepaid card if you have any problems with your card.

7. PURCHASES AND TRANSACTIONS

All purchases and transactions on or through the PSN are solely between you and SCEH. By completing a transaction through your master account or allowing a transaction to take place through an associated Sub Account, you are (i) agreeing to pay for all purchases including recurring charges for subscriptions that are not cancelled; (ii) authorizing SCEH to deduct from the wallet and charge your credit card all applicable fees due and payable for all purchases made by the Master Account and its associated Sub Accounts; (iii) agreeing to the current prevailing terms of this Agreement, as made available at http://www.scei.co.jp/ps3-eula/; and (iv) agreeing to any applicable Service Agreement and the terms of service associated with the particular content or services, subject to Paragraph 4 above. All sales are final upon the completion of your purchase, including purchase of subscriptions and other prepaid products or services. Purchased content or services are not refundable or transferable, and cannot be redeemed for cash or credit. SCEH reserves the right to deduct from the wallet any amount and associated fees resulting from any request by a Master Account holder to the Master Account holder's credit card company to reverse the charges for a purchase made on or through the PSN. SCEH also reserves the right to terminate the Master Account and all Sub Accounts associated with the Master Account in these circumstances. In lieu of termination of the Master Account in such circumstances, SCEH may elect to provide a mechanism by which a Master Account may fund the wallet to prevent the Master Account and its associated Sub Accounts from being terminated. All transactions are made in the currency of your country / area of residence. Features, specifications, prices, services and content are subject to change or withdrawal at any time and SCEH does not provide any refunds in the event of a price drop, a subsequent promotional offering or product removal. Special product, prices and promotions are no longer valid once they are changed or removed. All sales are subject to the laws of the Hong Kong Special Administrative Region, People's Republic of China.

You can make purchases only from a designated SCE regional company which is determined by your country / area of residence. Your country / area of residence may be verified by your credit or debit card number and may be rejected if the information does not match. If you are a Master Account holder, you will receive an email summary for each purchase after it is made, provided that you have given us a valid, current, operational email address. Please print and retain these emails for your records. You can view your purchase history in the PSN Account Management area.

Although SCEH will try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you promptly. You will have the option of either reconfirming your order at the correct price or canceling it. If we are unable to contact you, your order will be cancelled and the purchase price will be refunded to your wallet.

If you do not have sufficient funds in your wallet to make a purchase and you have previously entered your credit card information, we may automatically charge your credit card a minimum amount determined by SCEH (HKD40 if you are a Hong Kong resident, or RP4,000 if you are an Indonesia resident, or MYR15 if you are a Malaysia resident, or SGD10 if you are a Singapore resident, or TWD150 if you are a Taiwan resident, or THB300 if you are a Thailand resident) ("Minimum Fee") to make the purchase, even if the Minimum Fee exceeds the cost of your purchase. Any difference between the Minimum Fee and the cost of the purchase will be credited to your wallet. Additional procedures apply to subscription purchases. Please read Section 10 ("SUBSCRIPTIONS") of this Agreement for details.

For users with Taiwan as country / area of residence

As explained above, although all transactions are made in New Taiwan Dollars, all purchases and transactions on or through the PSN are solely between you and SCEH. Your credit card issuing company may treat such transactions as overseas transactions and may charge you overseas transaction fees or other related fees. Please enquire with your credit card issuing company before using your credit card for transaction.

8. PSN VOUCHERS AND PROMOTION CODES

PSN provides you with the ability to redeem certain content and services using PSN vouchers. Each voucher will be subject to specific terms and conditions which will be communicated to you with the voucher. Vouchers may not be available in all countries or to all users, and age restrictions may apply. Unless otherwise stated, vouchers may not be transferred or sold to any other person.

From time to time, SCEH may issue promotion codes which can be used to access promotional offers for PSN content or services. Each promotion code will be subject to specific terms and conditions which will be communicated to you in connection with the promotion. Promotion codes may not be available in all countries to all users, and age restrictions may apply. Promotion codes must be used before the specified expiration date, and in accordance with applicable terms and conditions. Unless otherwise stated, promotion codes may be used once only by the recipient and may not be transferred or sold to any other person.

9. GENERAL LICENSE RESTRICTIONS AND TERMS

All content and software provided through PSN are licensed non-exclusively and revocably to you and holders of your associated Sub Accounts (collectively for purposes of this section, "You" or "Your"), solely for Your personal, non-commercial use on the PlayStation®3 computer entertainment system, PSP® system and any other hardware devices authorized by SCE companies, subject to the terms of this Agreement. All intellectual property rights in the content and software, including content displayed, provided by or through PSN, and hardware used in connection with PSN (collectively defined as "Property"), belong to SCEH and its licensors and all use and/or access to such Property shall be subject to the terms of this Agreement and all applicable copyright and intellectual property laws. You must not sell, transfer, rent, sublicense, modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Property. You must not create any derivative works, attempt to create the source code from the object code, or download content or software for any purpose other than game play or other SCEH authorized use. Property is not licensed for resale or for public performance. Except as expressly granted in this Agreement, SCEH and its licensors reserve all rights, interests, and remedies in connection with PSN and/or the Property.

Additional terms of service and use may apply to particular content or services. Use may be restricted depending on the content or service. Please read carefully all specific terms of service and use for particular content or service before purchasing. The restrictions to which particular content or service is subject are in the sole discretion of SCEH or its licensors and are subject to change at any time. Use of the terms "purchase," "sale," "sell" or "buy" on PSN or in connection with PSN shall not mean or imply any transfer of ownership of any content, data or software or any intellectual property rights therein from SCE companies or its licensors to any user or third party. All other company, product, and service names appearing on PSN are trade names, trade marks, or registered trade marks of their respective owners.

10. SUBSCRIPTIONS

SCEH may offer you the opportunity to purchase subscriptions that provide access to particular products or services for a specified period of time. Subscriptions renew automatically unless you cancel the subscription. The cost of each subscription will automatically be deducted from your wallet at the beginning of each subscription term without further notice to you. Subscriptions may not be shared among any PSN accounts, including the Master Account with its associated Sub Accounts.

Some subscriptions may be single-product- or service-specific, while other subscriptions may be comprised of several content items, services or features, which may include special offers, discounted, free, paid-for, exclusive or early access content or automatic download of SCEH selected content. Individual content items and service within a composite subscription may also be offered for sale separately as a one-time purchase or single-product-specific subscription. Subscription charges may be increased at the end of each subscription term. As each product offering will have terms and conditions that vary, please review each product description, cost and subscription term carefully before purchase or download. As with all purchases, please print and retain a copy of your email purchase receipt for your reference.

SCEH may also offer a free trial period with some subscriptions. If you do not cancel your subscription before expiration of a trial period, your wallet will automatically be charged the cost of the subscription at the beginning of each subscription term without further notice to you. To avoid being charged, you must cancel your subscription prior to expiration. Please review all terms and conditions carefully before you accept any offer or promotion.

If you do not have sufficient funds in your wallet to cover the cost of your subscription at the time the subscription is renewed, the subscription will be cancelled unless the automatic funding feature on the Master Account is set to "ON." If the automatic funding feature on the Master Account is set to "ON," your credit card will be charged automatically the greater of the subscription cost or the Minimum Fee. Every time you or one of your associated Sub Accounts purchases a new subscription, the automatic funding feature in the Master Account is set automatically to "ON." The Master Account holder may change this setting to "OFF" at any time. However, the setting will return to "ON" upon subsequent purchase of any subscription, so setting your automatic funding feature to "OFF" may not effectively cancel your subscription. In order to stop receiving a subscription and avoid being charged, you must cancel your subscription in the PSN Account Management area.

If you no longer wish to receive your subscription, you must cancel your subscriptions via PSN account management. Cancellation will take effect at the beginning of the next subscription term. Except as otherwise stated in this Agreement, upon cancellation of your subscription or termination of the Master Account or Sub Account, you will not receive a refund or credit for any subscriptions for which you have paid. Further, you will not be able to access content or services provided in your subscription except as permitted by SCEH. Content which you downloaded onto a device and which was provided to you through a subscription at no additional cost beyond the subscription price may not be accessible. Game play information, including trophies earned during a trial offer, promotional period or subscription term may not be available.

11. MAINTENANCE

From time to time, it may become necessary for SCEH to provide certain content or services to you to ensure that PSN, your PlayStation®3 computer system, PSP® system and/or other hardware devices authorized by SCE companies are functioning properly in accordance with SCEH guidelines. Some content or services may be provided automatically without notice when you sign into PSN. Without limitation, such content or services may include automatic updates or upgrades which may change your current operating system, cause a loss of data or content or cause a loss of functionalities or utilities. Such upgrades or updates may be provided for system software for your PlayStation®3 computer system, PSP® system or other SCE-authorized hardware. Access or use to any system software is subject to terms and conditions of a separate end user license agreement found at http://www.scei.co.jp/ps3-eula/. You authorize SCEH to provide such content and services and agree that SCEH shall not be liable for any damages arising from the provision of such content or services.

12. PUBLIC INFORMATION

SCEH may provide all users with information relating to your game play. You hereby authorize SCEH to use, distribute, copy, display, and publish information relating to your game play for gaming purposes including tournaments and ranking, without payment to you. In addition, you may have the option to post, stream or transmit pictures, photographs, game related materials, music, home video content or other information through or in connection with PSN to share with others ("User Material"). We may provide you with content to use in the creation of User Material. User Material created by you will belong to you, although any content provided by us will still belong to us and/or our licensors.

You authorize and sublicense SCEH the right to authorize anyone to use, distribute, copy, modify, display and publish your User Material in any manner or any medium without payment to you, and you hereby waive all claims, including any moral rights, against SCEH, its affiliates and subsidiaries for SCEH or any other third party's use of User Material and game play information, as applicable. You must not commercially exploit User Material without our consent. By posting, streaming or transmitting any User Material you represent and warrant that you have the appropriate rights to use, post, distribute, and transmit the User Material and to grant SCEH the rights stated in the foregoing sentence. You further agree to cooperate with SCEH and its affiliates and subsidiaries in resolving any dispute that may arise from your posting, streaming or other transmission of User Material. SCEH reserves the right to refuse to post and/or to remove any User Material at its sole discretion without notice.

13. TERMINATION/ CANCELLATION

If SCEH determines in its sole discretion that you have violated any term of this Agreement or any other terms of service or agreements connected with PSN or have otherwise injured or damaged the PSN community, SCEH may take all actions to protect its interests, including termination or suspension of your PSN account (both the Master Account and any associated Sub Accounts), removal of content, implementation of upgrades or devices intended to discontinue unauthorized use, or reliance on any other remedial efforts as reasonably necessary to prevent the use of pirated content or unauthorized exploitation of PSN or SCE resources. Upon termination for any reason, you will not receive a refund for purchased items (including subscriptions and pre-paid products or services), value accumulated on in-game items or any unused balance in your wallet except as expressly provided in this Agreement. Any ranking or scores, or game related information will not be retained or accessible by you or your associated Sub Accounts. SCEH reserves the right to bring legal action and to participate in any government or private legal action or investigation relating to your conduct, which may require the disclosure of your personal information (or the personal information of your associated Sub Account holders), to which you hereby give your consent. Unless as otherwise stated in this Agreement, SCEH, at its sole discretion, may indefinitely suspend, or discontinue any and all online services and content at any time, including for maintenance service or upgrades, without prior notice or liability.

14. GENERAL LEGAL

SCEH, at its sole discretion, may modify the terms of this Agreement at any time, including imposing a fee for creating PSN accounts. By accepting this Agreement or by accessing PSN, you agree to be bound by all current terms of the Agreement. To access a printable, current copy of this Agreement, go to http://www.scei.co.jp/ps3-eula/ on your personal computer. If material changes to this Agreement are made, you will be notified by a posting as you sign in to PSN or by email. If necessary, you will be given additional choices regarding such change(s). Please check back from time to time to ensure that you are aware of these changes. Your continued use of PSN, including use of your associated Sub Account(s), will signify your acceptance of these changes. If you do not accept material changes to the Agreement and there are funds in your wallet prior to your refusal to accept material changes to the Agreement, those funds may be refunded to you, your account will be terminated and you will not be able to access PSN.

This Agreement shall be construed and interpreted in accordance with the laws of the Hong Kong Special Administrative Region, People's Republic of China. In the event of a dispute arising under or in relation to this Agreement, you submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region, People's Republic of China.

15. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

No express warranty is given about the quality, functionality, availability or performance of PSN, or any content or service offered on or though PSN. Without prejudice to the limitations of liability in Sections 1, 3 and 13 of this Agreement, SCEH expressly disclaims, to the extent permitted by applicable laws, any implied warranty of merchantability, warranty of fitness for a particular purpose, warranty of satisfactory quality and/or warranty of non-infringement. SCEH assumes no liability for any inability to purchase or use any content, goods or services. YOUR SOLE AND EXCLUSIVE RECOURSE IN THE EVENT OF ANY DISSATISFACTION WITH OR DAMAGE ARISING FROM PSN OR IN CONNECTION WITH THIS AGREEMENT AND SCEH'S MAXIMUM LIABILITY UNDER THIS AGREEMENT OR WITH RESPECT TO YOUR USE OF OR ACCESS TO PSN SHALL BE LIMITED TO YOUR DIRECT DAMAGES, NOT TO EXCEED THE UNUSED FUNDS IN YOUR WALLET AS OF THE DATE OF TERMINATION. EXCEPT AS OTHERWISE STATED IN THE FOREGOING SENTENCE, OR TO THE EXTENT THAT MAY OTHERWISE BE PROHIBITED OR PRECLUDED BY LAW, SCEH EXCLUDES ALL LIABILITY FOR ANY LOSS OF DATA, DAMAGE CAUSED TO YOUR SOFTWARE OR HARDWARE, AND ANY OTHER LOSS OR DAMAGE SUFFERED BY YOU OR ANY THIRD PARTY, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL AND HOWEVER ARISING, AS A RESULT OF ACCESSING OR DOWNLOADING CONTENT TO YOUR PlayStation®3 COMPUTER ENTERTAINMENT SYSTEM, THE PSP® SYSTEM, OR ANY HARDWARE UNIT OR USING OR ACCESSING THE PSN. YOU ARE RESPONSIBLE FOR YOUR INTERNET SERVICE PROVIDER FEES AND ANY OTHER FEES RELATED TO YOUR USE OF PSN, INCLUDING ANY INCREASE IN SUCH FEES RESULTING FROM YOUR USE OF PSN. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

AKSES ANDA KE SONY COMPUTER ENTERTAINMENT'S PLAYSTATION®NETWORK ("PSN") HANYA SECARA TEGAS DAPAT DILAKUKAN SETELAH ANDA MENERIMA KETENTUAN-KETENTUAN DALAM PERJANJIAN INI. ANDA TIDAK DAPAT MENGAKSES PSN JIKA ANDA MENEKAN TOMBOL TIDAK SETUJU ("DO NOT ACCEPT")

Perjanjian ini adalah sebuah kontrak antara anda dan Sony Computer Entertainment Hong Kong Limited ("SCEH") dan hanya bisa dilakukan oleh orang dewasa berusia 18 tahun (atau 21 tahun jika anda berdomisili di Singapura, atau 20 tahun jika anda berdomisili di Taiwan atau Thailand) atau lebih. Dengan menekan tombol "ACCEPT", anda dengan ini menyatakan bahwa anda seorang dewasa berusia 18 tahun (atau 21 tahun jika anda berdomisili di Singapura, atau 20 tahun jika anda berdomisili di Taiwan atau Thailand) atau lebih dan anda menerima dan setuju untuk terikat dengan ketentuan-ketentuan dalam Perjanjian ini. Anda juga menyatakan bahwa anda menerima Perjanjian ini untuk dan atas nama serta memikul segala tanggung jawab hukum dan keuangan dan tanggung jawab yang timbul dari segala aksi pemegang subordinate accounts ("Sub Accounts") yang melekat pada Master Account anda. Jika anda berusia dibawah 18 tahun (atau 21 tahun jika anda berdomisili di Singapura, atau 20 tahun jika anda berdomisili di Taiwan atau Thailand) anda tidak dapat menerima Perjanjian ini dan membuka Master Account. Anda harus meminta orang tua atau wali hukum anda untuk menerima Perjanjian ini dan membuka sebuah Sub Account atas nama anda.

Perjanjian ini belaku untuk pelayanan-pelayanan, piranti lunak (software) dan isi/materi yang diberikan oleh SCEH melalui atau yang berhubungan dengan PSN, termasuk melalui PlayStation®Store dan komunitas virtual baik yang dikirim kedalam PlayStation®3 computer entertainment system, the PSP® (PlayStation®Portable) system, komputer pribadi atau bentuk lainnya. Pelayanan, piranti lunak dan isi/materi tersebut termasuk fasilitas langganan, data, sistem piranti lunak, perbaikan, update atau keluaran terbaru dan material pelengkap.

Jika anda menerima Perjanjian ini, anda diharuskan mematuhi ketentuan-ketentuan di dalamnya dan di dalam perjanjian lainnya yang telah anda setujui dalam kaitannya dengan PSN serta semua ketentuan dan persyaratan yang berlaku untuk semua produk, pelayanan atau isi/materi yang anda beli atau akses di atau melalui PSN yang telah diberitahukan kepada anda pada saat anda membeli dan/atau mengakses. Anda dengan ini juga menyetujui ketentuan mengenai Kebijakan Privasi (Privacy Policy) dari PlayStation®Network.

Anda dengan ini setuju untuk tidak menggunakan PSN baik secara langsung maupun tidak langsung i) dalam bentuk apapun untuk kepentingan komersial, ii) dalam bentuk apapun yang melanggar hukum atau kode perilaku komunitas (the community code of conduct), atau iii) dalam bentuk apapun yang merugikan perusahaan Sony Computer Entertainment ("SCE") atau afiliasinya, subsidernya, pemberi lisensi, pemberi pelayanan (providers), rekan dan pemakainya. Anda juga setuju untuk tidak memakai piranti keras (hardware) atau piranti lunak (software) yang tidak sah untuk mengakses atau menggunakan PSN.

1. REGISTRASI AKUN PSN

PSN memberikan anda kesempatan untuk berpartisipasi dalam komunitas online SCE, bermain games online dan membeli isi/materi dan pelayanan seperti tingkatan baru dari permainan favorit anda maupun permainan atau langganan. PSN dapat tidak tersedia atau tidak mempunyai dukungan di sebagian negara dan dalam bahasa tertentu. Anda harus membuat sebuah akun PSN untuk dapat mengakses isi/materi dan pelayanan dari PSN. SCEH mempunyai hak untuk menolak pembuatan akun atas dasar kebijakan dan alasan apapun. Saat ini tidak ada biaya untuk membuat sebuah akun PSN, namun demikian biaya mungkin dibebankan untuk isi/materi dan/atau pelayanan online tertentu yang tersedia melalui PSN. Segala informasi yang diberikan pada saat registrasi akun PSN haruslah benar dan akurat. Ada dua jenis akun PSN, yaitu: Master Accounts dan Sub Accounts. Semua akun PSN mempunyai kotak surat (mailbox) terkait untuk menerima pesan text.

Untuk para pengguna yang berasal/berdomisili di Negara Hong Kong.

Jika anda berumur 18 tahun atau lebih, anda dapat membuat sebuah Master Account untuk anda sendiri. Setiap Master Account dapat membuat maksimum enam (6) Sub Accounts yang terasosiasi. Namun demikian, anda dilarang membuat Sub Account untuk orang yang berusia di bawah 18 tahun jika orang tersebut bukanlah anak anda atau anda bukan wali hukum dari orang tersebut. Sebuah Master Account mempunyai akses ke dan kontrol terhadap beberapa aspek dari Sub Accountnya, sebagai berikut: (i) aspek finansial, (ii) ketersediaan isi/materi dan (iii) fitur komunikasi tertentu. Korespondesi dari SCEH yang berkaitan dengan pembelian oleh Sub Account di PSN akan dikirim ke pemegang Sub Account dan pemegang Master Account yang terasosiasi. Seorang anak berusia dibawah 18 tahun hanya boleh memiliki sebuah Sub Account yang terasosiasi dengan sebuah Master Account milik orang tua atau wali hukumnya. Anda tidak akan dibebankan biaya untuk membuat sebuah Sub Account. Jika anda membuat sebuah Sub Account untuk anak di bawah umur 16 tahun, anda harus memberikan persetujuan anda kepada SCEH untuk menyingkap informasi yang dapat secara personal mengidentifikasikan anak anda kepada pihak ketiga sesuai dengan Kebijakan Privasi agar anak anda dapat berpartisipasi dalam aktivitas di PSN sepeti percakapan video dan suara dan gameplay. Jika anda tidak menyetujui penyingkapan informasi yang diperlukan ini, anda tidak akan dapat membuat sebuah Sub Account untuk anak tersebut. Jika semua informasi yang dibutuhkan telah diberikan, sebuah surat elektronik terpisah yang berisi sebuah PIN akan dikirim ke alamat surat elektronik Master Account lengkap dengan instruksi untuk menyelesaikan proses registrasi dengan memasukan PIN tersebut ke Sub Account melalui komputer pribadi anda. Dengan berpartisipasi di aktivitas komunitas PSN dan aktivitas in-game, anak anda mungkin menerima komunikasi dari orang dewasa.

Untuk para pengguna yang berasal/berdomisili di Negara Indonesia atau Malaysia.

Jika anda berumur 18 tahun atau lebih, anda dapat membuat sebuah Master Account untuk anda sendiri. Setiap Master Account dapat membuat maksimum enam (6) Sub Accounts yang terasosiasi. Namun demikian, anda dilarang membuat Sub Account untuk orang yang berusia di bawah 18 tahun jika orang tersebut bukanlah anak anda atau anda bukan wali hukum dari orang tersebut. Namun demikian, anda dilarang membuat Sub Account untuk orang yang berusia di bawah 21 tahun jika orang tersebut bukanlah anak anda atau anda bukan wali hukum dari orang tersebut. Sebuah Master Account mempunyai akses ke dan kontrol terhadap beberapa aspek dari Sub Accountnya, sebagai berikut: (i) aspek finansial, (ii) ketersediaan isi/materi dan (iii) fitur komunikasi tertentu. Namun demikian, anda dilarang membuat Sub Account untuk orang yang berusia di bawah 20 tahun jika orang tersebut bukanlah anak anda atau anda bukan wali hukum dari orang tersebut. Sebuah Master Account mempunya akses ke dan kontrol terhadap beberapa aspek dari Sub Accountnya, sebagai berikut: (i) aspek finansial, (ii) ketersediaan isi/materi dan (iii) fitur komunikasi tertentu. Anda tidak akan dibebankan biaya untuk membuat sebuah Sub Account. Jika anda membuat sebuah Sub Account untuk anak di bawah umur 20 tahun, anda harus memberikan persetujuan anda kepada SCEH untuk menyingkap informasi yang dapat secara personal mengidentifikasikan anak anda kepada pihak ketiga sesuai dengan Kebijakan Privasi agar anak anda dapat berpartisipasi dalam aktivitas di PSN seperti percakapan video dan suara dan gameplay. Jika anda tidak menyetujui penyingkapan informasi yang diperlukan ini, anda tidak akan dapat membuat sebuah Sub Account untuk anak tersebut. Jika semua informasi yang dibutuhkan telah diberikan, sebuah surat elektronik terpisah yang berisi sebuah PIN akan dikirim ke alamat surat elektronik Master Account lengkap dengan instruksi untuk menyelesaikan proses registrasi dengan memasukan PIN tersebut ke Sub Account melalui komputer pribadi anda. Dengan berpartisipasi di aktivitas komunitas PSN dan aktivitas in-game, anak anda mungkin menerima komunikasi dari orang dewasa.

Untuk para pengguna yang berasal/berdomisili di Negara Thailand.

Jika anda berumur 20 tahun atau lebih, anda dapat membuat sebuah Master Account untuk anda sendiri. Setiap Master Account dapat membuat maksimum enam (6) Sub Accounts yang terasosiasi. Namun demikian, anda dilarang membuat Sub Account untuk orang yang berusia di bawah 20 tahun jika orang tersebut bukanlah anak anda atau anda bukan wali hukum dari orang tersebut. Sebuah Master Account mempunyai akses ke dan kontrol terhadap beberapa aspek dari Sub Accountnya, sebagai berikut: (i) aspek finansial, (ii) ketersediaan isi/materi dan (iii) fitur komunikasi tertentu. Korespondesi dari SCEH yang berkaitan dengan pembelian oleh Sub Account di PSN akan dikirim ke pemegang Sub Account dan pemegang Master Account yang terasosiasi. SCEH atas dasar kebijakannya dapat mengirim korespondensi ke Master Account mengenai aktivitas Sub Account lainnya di PSN.

Seorang anak berusia dibawah 20 tahun hanya boleh memiliki sebuah Sub Account yang terasosiasi dengan sebuah Master Account milik orang tua atau wali hukumnya. Anda tidak akan dibebankan biaya untuk membuat sebuah Sub Account. Dengan berpartisipasi di aktivitas komunitas PSN dan aktivitas in-game, anak anda mungkin menerima komunikasi dari orang dewasa.

Beberapa isi/materi dan pelayanan mungkin tidak sesuai untuk anak-anak di bawah usia tertentu. Mohon periksa rating untuk isi/materi sebelum mengakses, mengunduh (downloading) atau membeli. Tidak semua isi/materi dan pelayanan mempunyai rating. Beberapa isi/materi secara khusus dibuat untuk diunduh ke PlayStation®3 computer entertainment system atau PSP® dan akan tersedia untuk semua pengguna dari perangkat tersebut. Harap pantau akses anak anda ke isi/materi, pelayanan dan komunikasi yang mungkin tidak sesuai dengan umurnya. Kontrol orang tua dari PSN mungkin tidak tersedia untuk beberapa materi tertentu termasuk materi yang telah diunduh, materi, pelayanan dan komunikasi yang tidak dirating dan mengalir (steamed). Anak anda mungkin tidak dapat mengakses isi/materi atau bermain games yang telah dirating untuk pengguna yang berusia lebih dewasa dari usia terdaftar anak anda. Di beberapa negara, orang tua dan wali hukum pemegang Master Account diperbolehkan untuk mengatur pengaturan kontrol orang tua mereka untuk menggantikan pembatasan isi/materi di Sub Account yang terasosiasi. Anda harus merahasiakan kata sandi (password) anda untuk mencegah penggunaan tidak sah terhadap akun PSN anda. Kami tidak bertanggung jawab atas penggunaan tidak sah terhadap sebuah akun PSN.

Beberapa informasi tertentu, termasuk Online ID anda atau segala Online ID yang anda buat untuk Sub Account yang terasosiasi, penyataan "About Me" anda, gambar avatar, Negara/tempat domisili, bahasa yang dipilih, judul game yang baru dimainkan akan tersedia kepada seluruh pengguna PSN termasuk anak-anak.

2. KOMUNITAS PSN

Saat ini pembelian tidak diwajibkan untuk dapat berpartisipasi di aktivitas umum komunitas PSN. Anda bebas untuk berbicara melalui suara dan video dengan teman-teman dan menikmati keuntungan single sign on tanpa harus membeli serta menikmati hiburan online yang tidak mengharuskan anda untuk berlangganan atau membeli.

3. KODE PERILAKU KOMUNITAS (COMMUNITY CODE OF CONDUCT)

Sebagai persyaratan dari Perjanjian ini, anda harus mematuhi kode perilaku berikut ini dan juga mengikuti kode perilaku yang wajar dan masuk akal. Pengguna diwajibkan untuk memperhatikan standar komunitas dan mencegah perilaku yang merusak dan mengelabuhi, menipu, hacking dan segala bentuk penyalahgunaan dari PSN. Hak-hak dari pemain lainnya juga harus dihormati.

Pelanggaran yang dilarang termasuk tapi tidak terbatas pada hal-hal sebagai berikut:

Kecuali secara jelas disyaratkan oleh hukum yang berlaku, saat ini SCEH tidak diharapkan atau diwajibkan untuk memantau semua aktivitas online di PSN, termasuk komunikasi. Namun demikian, SCEH mempunyai hak untuk memantau dan mencatat/merekam semua aktivitas online di PSN dan anda dengan ini dengan tegas memberi persetujuan anda kepada SCEH untuk mencatat semua aktivitas anda di PSN. SCEH juga mempunyai hak untuk menghilangkan/membuang segala isi/materi dari mana saja atas dasar kebijakannya tanpa pemberitahuan. SCEH tidak mempunyai tanggung jawab atas segala pelanggaran dari Perjanjian ini oleh anda atau pemegang Sub Account yang terasosiasi dengan Master Account anda atau oleh pemain lainnya. Anda dengan ini menyatakan setuju untuk melindungi SCEH dari segala tuntutan atau permintaan terhadap SCEH yang berkaitan dengan segala bentuk pelanggaran terhadap Perjanjian ini oleh anda atau pemegang Sub Accounts yang terasosiasikan dengan Master Account anda dan setuju untuk membebaskan SCEH dari segala tuntutan atau permintaan yang mungkin anda punya sebagai hasil atau dalam kaitannya dengan pelanggaran Perjanjian ini oleh pemain lainnya.

4. ISI/MATERI DAN PELAYANAN DI PSN

PSN menyediakan anda fasilitas untuk membeli dan menebus berbagai macam isi/materi dan layanan, termasuk barang-barang spesifik yang berhubungan dengan game, seperti gambar dan tingkatan and gameplay yang baru serta permainan dan langganan. Semua isi/materi dan pelayanan yang tersedia di PSN adalah disediakan oleh SCEH, termasuk isi/materi yang dibuat dan dipublikasikan oleh pihak ketiga. Namun demikian, kami tidak bertanggung jawab atas isi/materi yang dimasukkan, dialirkan langsung (streamed) atau dikirim oleh pengguna PSN lainnya. Pihak ketiga termasuk penerbit mungkin mengatur sebagian dari pelayanan tersebut, termasuk pengiriman gameplay atau pelayanan pelanggan untuk beberapa jenis permainan atas nama SCEH. Kami harus memberikan pihak ketiga tersebut informasi personal anda, dan jika anda pemegang Master Account, informasi pemegang Sub Account yang terasosiasi dengan anda agar pihak ketiga tersebut dapat memberikan pelayanan yang dimaksud. Anda tidak dapat berpartisipasi di PSN jika anda tidak memberikan persetujuan anda untuk memperbolehkan kami memberikan informasi personal anda dan informasi personal dari pemegang Sub Account yang terasosiasi dengan anda kepada pihak ketiga dalam kaitannya untuk memberikan anda pelayanan di PSN. Untuk dapat mengakses isi/materi atau pelayanan tertentu, anda mungkin diwajibkan untuk menerima ketentuan spesifik mengenai isi layanan (content-specific terms of service) tambahan ("Service Agreement"). Terlepas dari segala ketentuan dari segala perjanjian lainnya, dalam hal terdapat ketidaksesuaian antara Perjanjian ini dan Service Agreement atau ketentuan pelayanan lainnya dalam kaitannya dengan PSN atau produk disc lainnya yang dipakai dengan PSN, Perjanjian ini yang akan berlaku.

Selain itu anda dapat mengatur PlayStation®3 computer entertainment system anda atau perangkat sah lainnya untuk secara otomatis mengunduh atau menerima isi/materi baru tanpa pemberitahuan lebih lanjut ketika anda masuk ke dalam PSN. Perjanjian ini juga berlaku untuk isi/materi tersebut.

5. DOMPET (WALLET)

Untuk beberapa Negara, anda dapat membeli isi/materi dan pelayanan dari PlayStation®Store maupun toko in-game yang terasosiasi dengannya dengan menggunakan dana dari sebuah dompet elektronik PSN. Semua pembelian yang dilakukan melalui Master Account dan melalui Sub Account yang terasosiasi dengan akun anda harus dibuat melalui dompet PSN yang dibuat untuk Master Account anda. Sebuah Sub Account tidak mempunyai dompet terpisah untuknya. Master Account dapat mengatur pengeluaran maksimum untuk setiap Sub Account yang akan efektif disetiap awal bulan berikutnya. Pemegang sebuah Master Account dapat membiayai dompet PSN sampai dengan jumlah maksimum yang ditentukan oleh SCEH ("Limit") baik melalui (i) kartu kredit; (ii) kartu prabayar apabila tersedia (iii) metode pembayaran lain yang disetujui oleh SCEH dari waktu ke waktu.
SCEH mempunyai hak untuk menolak pembelian dana untuk dompet atas dasar apapun. Selain dari yang diperbolehkan oleh hukum atau secara tegas diberikan oleh Perjanjian ini, dana yang dimasukkan ke dalam dompet tidak dapat ditransfer lagi. Dana yang terdapat di dompet tidak mempunyai nilai di luar PSN dan hanya dapat digunakan untuk membeli isi/materi dan pelayanan dari SCEH. Dana di dompet PSN yang dianggap diabaikan atau tidak digunakan menurut hukum tidak akan dikembalikan dan direstorasi. Dana yang dimasukkan ke dalam dompet tidak dapat dikembalikan kecuali hal tersebut diijinkan oleh hukum yang berlaku. Permintaan untuk pengembalian dana di dalam dompet PSN dapat dibuat secara tertulis ke SCEH di Suites 1501-1506, 15/F, Sun Life Tower, The Gateway, Harbour City, Tsim Sha Tsui, Kowloon, Hong Kong. Biaya administrasi akan dikenakan untuk semua aplikasi pengembalian yang dibuat dan diproses oleh SCEH. SCEH tidak mempunyai kewajiban untuk mematuhi segala permintaan pengembalian termasuk dalam situasi dimana dana di dalam dompet PSN telah dianggap diabaikan atau tidak dipakai sesuai dengan hukum atau apabila ada ketentuan dalam Perjanjian ini yang tidak dipatuhi. Segala pengembalian akan dilakukan dengan mengkreditkan ke kartu kredit atau debit anda.

Untuk para pengguna yang berasal atau berdomisili di negara Taiwan

Sesuai dengan ketentuan dari pemerintah Taiwan berkaitan dengan penerbitan kwitansi untuk pembelian barang di internet, SCEH melalui perusahaan afiliasinya, Sony Computer Entertaintment Taiwan Limited (SCET), akan menerbitkan kwitansi dalam jangka waktu 10 hari dari tanggal pengisian dompet PSN (kecuali pengisian menggunakan kartu prabayar). Untuk memperoleh kwintansi melalui pos, harap hubungi pelayanan pelanggan SCEH di 0809 079 888 (TAIWAN) dalam jangka waktu 5 hari setelah tanggal pengisian dompet PSN untuk mengkonfirmasi alamat pengiriman dan isi kwitansi. Jika SCET tidak menerima permintaan untuk pengiriman kwitansi melalui pos dalam jangka waktu 5 hari setelah tanggal pengisian dompet PSN, kwitansi tersebut akan di donasikan ke yayasan derma yang dipilih oleh SCEH tanpa pemberitahuan lebih lanjut.

6. KARTU PRABAYAR (PREPAID CARDS)

Setiap Master Account dan Sub Account asosiasinya dibatasi oleh Limit. Jika anda memperoleh atau membeli sebuah kartu prabayar yang apabila jumlah dananya ditambahkan dengan jumlah dana yang ada di dompet, jumlah keseluruhannya akan melewati Limit, dalam hal ini anda tidak akan dapat menambahkan nilai dari kartu prabayar tersebut ke dalam dompet kecuali sejumlah dana telah dihabiskan dari dompet itu sehingga apabila ditambahkan jumlah nilai penuh dari kartu prabayar dan yang ada di dompet akan menyamai atau kurang dari Limit. Kartu prabayar dapat dijual oleh distributor resmi atau penjual retail dan merupakan tanggung jawab para distributor resmi dan penjual retail itu sendiri. SCEH tidak bertanggung jawab atau mempunyai tanggung jawab atas segala tuntutan sebagai akibat dari segala masalah yang timbul karena penggunaan kartu prabayar atau cacat pada kartu prabayar. Silakan hubungi distributor atau penjual retail tempat anda membeli kartu prabayar jika anda mengalami masalah dengan kartu anda.

7. PEMBELIAN DAN TRANSAKSI

Semua pembelian dan transaksi di atau melalui PSN dibuat semata-mata antara anda dan SCEH. Dengan menyelesaikan sebuah transaksi melalui Master Account anda atau memperbolehkan sebuah transaksi dilakukan melalui sebuah Sub Account yang terasosiasi dengannya, anda dengan ini menyatakan (i) setuju untuk membayar semua pembelian tersebut termasuk biaya secara berketerusan untuk langganan yang tidak dibatalkan; (2) memberikan persetujuan kepada SCEH untuk memotong semua biaya yang timbul yang harus dibayar untuk semua pembelian yang dilakukan oleh Master Account dan Sub Accounts yang terasosiasi dengannya dari dompet maupun kartu kredit anda; (iii) setuju dengan ketentuan mengikat dari Perjanjian ini yang tersedia di http://www.scei.co.jp/ps3-eula/; dan (iv) setuju terhadap semua Service Agreement dan ketentuan pelayanan yang berkaitan dengan isi/materi dan pelayanan tertentu sesuai dengan paragraf 4 diatas. Semua penjualan adalah bersifat final setelah pembelian anda selesai, termasuk pembelian terhadap langganan atau produk maupun layanan yang telah dibayar (prepaid) lainnya. Isi/materi atau pelayanan yang sudah dibeli tidak dapat dikembalikan atau ditransfer dan tidak dapat ditukar dengan uang atau kredit. SCEH mempunyai hak untuk memotong/mengambil dari dompet semua dana dan biaya terkait yang timbul dari permintaan oleh pemegang Master Account kepada perusahaan kartu kredit milik pemegang Master Account untuk mengganti biaya yang timbul karena pembelian di atau melalui PSN. SCEH juga mempunyai hak untuk menutup Master Account dan semua Sub Accounts yang terasosiasi dalam keadaan ini. Sebagai pengganti penutupan Master Account dalam situasi tersebut, SCEH dapat memilih untuk menyediakan sebuah mekanisme dimana sebuah Master Account dapat membiayai dompet untuk mencegah Master Account dan Sub Accounts yang terasosiasi dengannya untuk ditutup. Semua transaksi dilakukan dengan menggunakan mata uang di Negara/ tempat domisili anda. Fitur, spesifikasi, harga, layanan dan isi dapat dirubah atau ditarik kapan saja dan SCEH tidak akan memberikan segala bentuk pengembalian dalam hal penurunan harga, penawaran promosi berikutnya atau penarikan produk. Produk, harga maupun promosi spesial dinyatakan tidak berlaku lagi apabila hal tersebut dirubah maupun ditarik. Semua penjualan juga tunduk pada hukum di Daerah Administrasi Spesial Hong Kong, Republik China.

Anda hanya dapat melakukan pembelian melalui dari perusahaan SCE regional yang ditunjuk dimana hal ini ditentukan oleh negara/ tempat domisili anda. Negara/tempat domisili anda dapat diverifikasi dari nomor kartu kredit/debit anda dan dapat ditolak apabila informasi tersebut tidak cocok. Jika anda merupakan seorang pemegang Master Account, anda akan menerima sebuah surat elektronik yang merangkum sebuah pembelian setelah pembelian tersebut dilakukan selama anda telah memberikan kami sebuah alamat elektronik yang masih berlaku, beroperasional dan valid. Harap cetak dan simpan surat elektronik (email) tersebut untuk catatan anda. Anda dapat melihat sejarah pembelian anda di area PSN Account Management.

Walaupun SCEH akan berupaya untuk menjamin bahwa semua harga adalah akurat, kesalahan tetap dapat terjadi. Kami akan menghubungi anda secepatnya jika kami menemukan sebuah kesalahan mengenai harga dari barang-barang yang telah anda pesan. Anda akan diberikan pilihan untuk mengkonfirmasi ulang order anda dengan harga yang tepat atau membatalkan order tersebut. Jika kami tidak dapat menghubungi anda, order anda akan dibatalkan dan biaya pembelian akan dikembalikan ke dompet anda.

Jika anda tidak mempunyai dana yang cukup dalam dompet anda untuk melakukan pembelian dan anda sebelumnya telah memasukan informasi kartu kredit anda, kami dapat secara otomatis membebankan kartu kredit anda biaya minimum yang ditentukan oleh SCEH (HKD 40 jika anda tinggal di Hong Kong, RP 4.000 jika anda tinggal di Indonesia, MYR 15 jika anda tinggal di Malaysia, SGD 10 jika anda tinggal di Singapura, TWD 150 jika anda tinggal di Taiwan atau THB 300 jika anda tinggal di Thailand) (“Biaya Minimun”) untuk dapat melakukan pembelian, bahkan dalam hal Biaya Minimun tersebut dapat melebihi harga dari pembelian anda. Setiap perbedaan antara Biaya Minimun dan biaya pembelian akan dimasukan dalam dompet anda. Prosedur tambahan juga berlaku bagi pembelian langganan. Harap baca Bagian 10 (Langganan) dari perjanjian ini untuk keterangan lebih lanjut.

Untuk Pengguna yang berdomisili di atau menggunakan Negara Taiwan.

Seperti telah dijelaskan di atas, semua pembelian dan transaksi di atau melalui PSN adalah semata-mata terjadi antara anda dengan SCEH walaupun semua transaksi tersebut dilakukan dengan menggunakan New Taiwan Dollars. Penerbit kartu kredit anda dapat menganggap transaksi tersebut sebagai transaksi di luar negeri dan membebankan biaya transaksi luar negeri atau biaya terkait lainnya. Harap hubungi perusahaan penerbit kartu kredit anda sebelum menggunakan kartu kredit anda untuk melakukan transaksi.

8. KODE PROMOSI DAN VOUCHER PSN

PSN memberikan anda kesempatan untuk menebus isi/materi dan pelayanan tertentu dengan menggunakan voucher PSN. Setiap voucher tunduk pada syarat dan ketentuan tertentu yang akan dikomunikasikan kepada anda bersamaan dengan voucher tersebut. Voucher mungkin tidak tersedia di semua negara untuk semua pengguna dan pembatasan usia dapat diberlakukan. Kecuali disebutkan lain, voucher tidak dapat ditransfer atau dijual kepada orang lain.

Dari waktu ke waktu SCEH dapat mengeluarkan kode promosi yang dapat digunakan untuk mengakses penawaran promosi untuk isi/materi atau pelayanan PSN. Setiap kode promosi tunduk pada syarat dan ketentuan tertentu yang akan dikomunikasikan kepada anda dalam kaitannya dengan promosi tersebut. Kode promosi mungkin tidak tersedia di semua negara untuk semua pengguna dan pembatasan usia dapat diberlakukan. Kode promosi harus digunakan sebelum tanggal kadaluarsa yang tertera dan sesuai dengan syarat dan ketentuan yang berlaku. Kecuali disebutkan lain, kode promosi hanya dapat digunakan sekali oleh penerima dan tidak dapat ditransfer atau dijual kepada orang lain.

9. KETENTUAN DAN PEMBATASAN LISENSI UMUM.

Semua isi/materi dan piranti lunak yang disediakan oleh PSN dilisensikan kepada anda dan pemegang Sub Accounts yang terasosiasi (secara kolektif untuk tujuan bagian perjanjian ini disebut sebagai "Anda"), secara non-eksklusif dan dapat dibatalkan serta semata-mata hanya untuk kepentingan pribadi Anda dan hanya untuk pengunaan non-komersial dari PlayStation®3 computer entertainment system, PSP® system dan perangkat resmi lainnya dari perusahaan SCE sesuai dengan ketentuan dalam Perjanjian ini. Semua hak kekayaan intelektual yang melekat di isi/materi dan piranti lunak, termasuk isi/materi yang dipajang, yang disediakan oleh atau melalui PSN, serta piranti keras yang digunakan terkait dengan PSN (secara kolektif dirujuk dengan kata "Property"), dimiliki oleh SCEH dan pemberi lisensinya dan semua penggunaan dan/atau akses terhadap Property tersebut diatur oleh ketentuan-ketentuan dalam Perjanjian ini serta seluruh hukum hak cipta dan hak kekayaan intelektual yang berlaku. Anda tidak boleh menjual, mentransfer, menyewakan, melisensikan kembali (sublicense), mengubah, mengadaptasi, menyadurkan, merekayasa ulang (reverse engineer), membongkar atau memisahkan bagian dari Property ini. Anda tidak boleh menciptakan hasil turunan, mencoba menciptakan kode sumber dari kode objek, atau mengunduh isi/materi atau piranti lunak untuk tujuan apapun selain dari gameplay atau penggunaan lainnya yang diijinkan oleh SCEH. Property tidak untuk dilisensikan, untuk dijual kembali atau untuk kepentingan pertunjukkan umum. Kecuali diperbolehkan secara eksplisit oleh Perjanjian ini, SCEH dan pemberi lisensinya memegang hak penuh atas semua hak, kepentingan, dan penuntutan pembayaran ganti rugi yang berhubungan dengan PSN dan/atau Property.

Syarat dan ketentuan tambahan mengenai pelayanan dan penggunaan dapat berlaku untuk isi/materi atau pelayanan tertentu. Penggunaan bisa dibatasi bergantung pada isi/materi dan pelayanannya. Harap baca dengan seksama semua ketentuan khusus pelayanan dan penggunaan untuk isi/materi atau pelayanan tertentu sebelum membeli. Pembatasan-pembatasan atas isi/materi maupun pelayanan tertentu merupakan hak tunggal/diskresi dari SCEH atau pemberi lisensinya dan dapat dirubah kapan saja. Penggunaan kata-kata 'pembelian', 'penjualan'. 'menjual', atau 'membeli' di PSN atau yang terkait dengan PSN tidak berarti atau tidak mengimplikasikan adanya transfer kepemilikan isi/materi, data, atau piranti lunak atau hak kekayaan intelektual apapun dari perusahaan SCE atau pemberi lisensinya kepada pengguna manapun atau pihak ketiga. Semua nama perusahaan, produk, dan pelayanan yang muncul di PSN adalah merek dagang, merek atau merek terdaftar dari para pemilik masing-masing produk.

10. LANGGANAN (SUBSCRIPTIONS)

SCEH dapat menawarkan kepada anda kesempatan untuk membeli langganan yang memberikan akses ke produk dan layanan tertentu dalam jangka waktu tertentu. Langganan akan diperbaharui secara otomatis kecuali anda membatalkan langganan tersebut. Biaya setiap langganan akan secara otomatis dipotong dari dompet anda pada setiap awal periode langganan tersebut tanpa pemberitahuan lebih lanjut kepada anda. Langganan mungkin tidak dapat dinikmati secara bersama-sama oleh akun-akun PSN termasuk Master Accounts dan Sub Accounts yang terasosiasi dengannya.

Beberapa layanan dapat hanya untuk satu produk maupun layanan secara spesifik sedangkan layanan lainnya dapat terdiri dari berbagai jenis isi/materi (content), layanan maupun fitur yang mungkin termasuk penawaran special, isi/materi yang telah diskon, gratis, telah dibayar, eksklusif ataupun akses awal/terlebih dahulu terhadap sebuah isi/materi (early access content) atau pengunduhan isi tertentu dari SCEH secara otomatis. Item isi/materi dan layanan tersendiri yang merupakan bagian dari langganan yang terdiri dari berbagai bagian (composite subscriptions) dapat juga dijual secara terpisah dalam bentuk satu kali pembelian (one time purchase) atau langganan produk spesifik tersendiri. Biaya berlangganan mungkin dinaikkan pada akhir tiap periode langganan. Oleh karena setiap produk mempunyai persyaratan dan ketentuan yang berbeda-beda, anda diharapkan untuk membaca secara cermat deskripsi setiap produk tersebut maupun ketentuan biaya dan langganan tersebut sebelum membeli atau melakukan pengunduhan. Seperti halnya dalam setiap pembelian, harap cetak dan simpan salinan dari kwintasi pembelian surat elektronik anda untuk referensi anda.

SCEH dapat juga menawarkan penggunaan dalam waktu terbatas (free trial period) untuk beberapa langganan. Biaya langganan akan secara otomatis dibebankan kepada dompet anda yang akan ditarik pada setiap periode awal dari langganan tersebut tanpa pemberitahuan lebih lanjut jika anda tidak membatalkan langganan anda sebelum jangka waktu terbatas tersebut habis. Untuk menghindari pembebanan biaya, anda harus membatalkan langganan tersebut sebelum jangka waktunya habis. Harap baca persyaratan dan ketentuan secara cermat sebelum anda menerima segala penawaran atau promosi.

Jika anda tidak memiliki dana yang cukup dalam dompet anda untuk membayar biaya langganan pada saat langganan tersebut diperbaharui, langganan tersebut akan dibatalkan kecuali fitur pendanaan otomatis di Master Account anda dipilih dalam keadaan “ON”. Jika fitur pendanaan otomatis di Master Account dalam keadaan “ON”, kartu kredit anda akan secara otomatis dibebankan biaya langganan yang terbesar atau Biaya Minimun. Fitur pendanaan otomatis akan secara otomatis diletakkan pada posisi “ON” setiap saat anda atau Sub Accounts yang terasosiasi dengan anda membeli sebuah langganan baru. Pemegang Master Account dapat setiap saat merubah posisi ini ke posisi “OFF”. Namun demikian, posisi ini akan kembali ke posisi “ON” setelah pembelian segala bentuk layanan selanjutnya, oleh karena itu memposisikan fitur pendanaan otomatis ke posisi “OFF” tidak secara efektif membatalkan langganan anda. Anda harus membatalkan layanan anda di area PSN Account Management agar dapat menghentikan menerima langganan dan menghindari untuk dikenakan biaya.

Anda harus membatalkan langganan anda melalui PSN account management jika anda tidak lagi berkeinginan untuk melanjutkan langganan anda. Pembatalan akan berlaku secara efektif pada awal period langganan selanjutnya. Kecuali secara tegas dinyatakan sebaliknya dalam Perjanjian ini, setelah pembatalan langganan anda atau penutupan Master Account atau Sub Account, anda tidak akan menerima pengembalian atau kredit terhadap segala langganan yang telah anda bayar.

Selanjutnya, anda tidak akan dapat mengakses isi/materi atau layanan yang diberikan oleh langganan anda kecuali yang diijinkan oleh SCEH. Isi/materi yang telah anda unduh ke dalam perangkat dan yang diberikan tanpa biaya tambahan selain biaya langganan kepada anda melalui sebuah langganan mungkin tidak dapat lagi dapat diakses. Informasi game play termasuk piala yang diperoleh selama masa percobaan, promosi atau masa berlangganan dapat tidak lagi tersedia.

11. PERAWATAN

Dari waktu ke waktu, SCEH dapat menyediakan isi/materi atau pelayanan tertentu kepada anda untuk memastikan bahwa PSN, PlayStation®3 computer entertainment system, PSP® system anda dan/atau perangkat resmi dari perusahaan SCE lainnya bisa berfungsi dengan baik sesuai dengan petunjuk SCEH jika hal ini dianggap perlu. Beberapa isi/materi dan pelayanan dapat tersedia secara otomatis tanpa pemberitahuan lebih lanjut ketika anda masuk ke dalam PSN. Tanpa pembatasan, isi/materi atau pelayanan tersebut dapat termasuk update atau pembaharuan secara otomatis yang bisa mengubah sistem operasi anda sekarang, menyebabkan kehilangan data atau isi atau menyebabkan kehilangan fungsi dan kegunaan. Pembaharuan atau update tersebut bisa disediakan untuk sistem piranti lunak untuk PlayStation®3 computer entertainment system, PSP® system anda dan/atau perangkat resmi dari perusahaan SCE lainnya. Akses atau penggunaan sistem piranti lunak ini tunduk dan diatur secara terpisah di dalam syarat dan ketentuan dari perjanjian lisensi pengguna akhir yang terdapat di http://www.scei.co.jp/ps3-eula/. Anda dengan ini memberikan persetujuan anda kepada SCEH untuk menyediakan isi /materi dan pelayanan tersebut dan menyetujui bahwa SCEH tidak bertanggung jawab untuk kerusakan/kerugian apapun yang muncul dari ketentuan penyediaan isi/materi maupun pelayanan tersebut.

12. INFORMASI PUBLIK

SCEH bisa menyediakan informasi terkait dengan gameplay anda kepada semua pengguna. Anda dengan ini memberikan persetujuan anda kepada SCEH untuk menggunakan, mendistribusikan, menampilkan, dan mempublikasikan informasi yang terkait dengan gameplay untuk tujuan permainan termasuk turnamen dan ranking, tanpa pembayaran kepada anda. Selain itu, anda mungkin diberikan pilihan untuk memasukkan, stream atau mengirim gambar, foto, materi yang terkait dengan permainan, musik, materi video rumah (home video content) atau informasi lainnya melalui atau yang berkaitan dengan PSN untuk membaginya dengan pihak lainnya (“User Material”) . Kami dapat menyediakan isi/materi untuk dapat anda gunakan dalam membuat User Material. User Material yang anda buat akan tetap menjadi milik anda walapun segala isi/materi yang kami sediakan akan tetap menjadi milik kami dan/atau lisensor kami.

Anda dengan ini memberikan persetujuan anda and sub lisensi (sublicense) kepada SCEH untuk menyetujui orang lain untuk menggunakan, mendistribusikan, mengopi, memodifikasi, menunjukkan dan menerbitkan User Material anda dengan cara atau media apapun tanpa harus membayar kepada anda serta anda dengan ini menyatakan persetujuan anda untuk mengabaikan semua klaim yang anda punya terhadap hal tersebut, termasuk segala hak moral terhadap SCEH, afiliasinya dan perusahaan subsidernya SCEH atau penggunaan User Material dan informasi gameplay yang dilakukan oleh pihak ketiga. Anda dilarang untuk secara komersial mengeksploitasi User Material tanpa seijin dari kami. Dengan memasukan, streaming atau mengirimkan jenis User Material apapun, anda menyatakan dan menjamin bahwa anda memiliki hak secara hukum untuk menggunakan, memasukkan, mendistribusikan dan mengirimkan User Material tersebut serta untuk memberikan kepada SCEH hak-hak sebagaimana dijelaskan dalam kalimat di atas. Anda juga menyatakan persetujuan anda untuk bekerjasama dengan SCEH dan afiliasinya serta perusahaan subsidernya untuk menyelesaikan masalah yang mungkin muncul dari pemasukan, streaming dan bentuk pengiriman lainnya dari User Material. SCEH mempunyai hak untuk menolak pemasukan dan/atau untuk mengganti User Material apapun atas dasar kebijakannya sendiri tanpa pemberitahuan.

13. PENUTUPAN/PEMBATALAN

Jika SCEH melalui diskresinya sendiri telah menentukan bahwa anda telah melanggar ketentuan dalam Perjanjian ini atau dari ketentuan dari pelayanan atau perjanjian-perjanjian yang terkait dengan PSN atau mengakibatkan kerugian kepada komunitas PSN, SCEH dapat mengambil semua tindakan untuk melindungi kepentingannya, termasuk membatalkan atau menghentikan secara sementara akun PSN anda (termasuk Master Account dan Sub accounts lainnya yang terasosiasi), membuang isi/materi, mengimplementasikan upgrades atau peralatan untuk menghentikan penggunaan tidak sah atau melakukan usaha-usaha perbaikan wajar lainnya yang diperlukan untuk mencegah penggunaan isi yang dibajak atau eksploitasi tidak resmi terhadap PSN atau sumber kemampuan/kepemilikan SCE lainnya. Setelah dilakukan pembatalan atas dasar alasan apapun, anda tidak akan menerima pembayaran kembali untuk barang-barang yang sudah dibeli (termasuk langganan dan produk atau layanan yang sudah dibayar (pre-paid)), menerima nilai yang sudah terakumulasikan dalam ketentuan in-game atau menerima jumlah dana di dompet yang belum digunakan kecuali secara eksplisit disebutkan lain dalam Perjanjian ini. Semua ranking, nilai, atau informasi yang terkait dengan permainan tidak akan dapat disimpan atau diakses oleh anda atau Sub Accounts yang terasosiasikan dengan anda. SCEH mempunyai hak untuk melakukan tindakan hukum atau berpartisipasi dalam tindakan hukum dari pemerintah atau privat atau investigasi yang berhubungan dengan perbuatan anda, yang mungkin mengharuskan pembukaan informasi personal anda (atau informasi personal dari pemegang Sub Accounts yang terasosiasi dengan anda), yang mana dalam hal ini anda juga dianggap telah menyatakan memberikan izin untuk dilakukannya hal tersebut. Selain dari yang ditentukan dalam Perjanjian ini, SCEH atas dasar kebijakannya dapat secara tidak terbatas menghentikan atau tidak melanjutkan semua atau beberapa bentuk pelayanan online atau isi/materi kapan saja, termasuk perawatan untuk pelayanan atau upgrades tanpa pemberitahuan atau pertanggung jawaban sebelumnya.

14. KETENTUAN HUKUM UMUM

SCEH atas dasar kebijakannya dapat memodifikasi ketentuan dalam Perjanjian ini kapan saja, termasuk menetapkan biaya untuk membuat akun PSN. Dengan menyetujui Perjanjian ini atau dengan mengakses PSN, anda dianggap memberikan persetujuan anda untuk terikat oleh semua ketentuan yang berlaku dalam Perjanjian ini. Untuk mengakses salinan atau bentuk salinan yang dapat dicetak dari Perjanjian yang berlaku ini silakan kunjungi http://www.scei.co.jp/ps3-eula/ melalui komputer pribadi anda. Jika terjadi perubahan material terhadap Perjanjian ini, anda akan diberitahukan ketika anda masuk ke PSN atau melalui email. Jika diperlukan, anda akan diberikan pilihan tambahan terkait dengan perubahan-perubahan tersebut. Harap periksa secara berkala untuk memastikan bahwa anda mengetahui perubahan-perubahan tersebut. Keberlanjutan penggunaan anda atas PSN, termasuk penggunaan Sub Accounts yang terasosiasi dengan anda dianggap menunjukkan persetujuan anda terhadap perubahan-perubahan ini. Jika anda tidak menerima perubahan material dalam Perjanjian ini dan apabila masih terdapat dana dalam dompet anda sebelum penolakan anda terhadap perubahan material dalam Perjanjian ini, dana itu dapat dikembalikan kepada anda, akun anda akan diterminasi dan anda tidak bisa mengakses PSN lagi.

Perjanjian ini harus diterjemahkan dan diinterpretasikan sesuai dengan hukum yang berlaku di Daerah Administrasi Spesial Hong Kong, Republik China. Jika terjadi sengketa yang muncul dari atau terkait dengan Perjanjian ini, anda dengan ini menyatakan persetujuan anda untuk tunduk pada jurisdiksi non eksklusif pengadilan di Daerah Administrasi Spesial Hong Kong, Republik China.

15. PERNYATAAN GARANSI DAN PEMBATASAN TANGGUNG JAWAB

Tidak ada garansi secara eksplisit yang diberikan untuk kualitas, fungsi, ketersediaan atau kinerja dari PSN atau segala isi/materi atau layanan yang ditawarkan di dalam atau melalui PSN . Tanpa mengurangi pembatasan tanggung jawab dalam bagian 1, 3 dan 13 dari Perjanjian ini dan sejauh yang diizinkan oleh hukum yang berlaku, SCEH dengan ini secara tegas menyatakan tidak adanya garansi secara tersembunyi/ implisit dari penjualan, garansi dari kondisi barang untuk tujuan tertentu, garansi kepuasan atas kualitas dan/atau garansi untuk tidak adanya pelanggaran hukum. SCEH tidak bertanggung jawab untuk ketidakmampuan untuk membeli atau menggunakan isi/materi, barang, atau pelayanan. JALUR SATU-SATUNYA DAN EKSKLUSIF YANG DAPAT ANDA AMBIL TERHADAP KETIDAKPUASAN ATAS ATAU KERUGIAN YANG DITIMBULKAN OLEH PSN ATAU YANG BERHUBUNGAN DENGAN PERJANJIAN INI DAN TANGGUNG JAWAB MAKSIMUM DARI SCEH DALAM PERJANJIAN INI ATAU TERKAIT DENGAN PENGGUNAAN ANDA ATAU AKSES KE PSN, DIBATASI TERHADAP KERUGIAN LANGSUNG YANG ANDA DERITA, YANG TIDAK MELEBIHI DANA YANG TIDAK TERPAKAI DALAM DOMPET PADA SAAT TERMINASI. KECUALI APABILA DISEBUTKAN DALAM KALIMAT DI ATAS ATAU SEJAUH YANG DILARANG ATAU DIKECUALIKAN OLEH HUKUM, SCEH TIDAK BERTANGGUNG JAWAB ATAS KEHILANGAN DATA, KERUSAKAN YANG TERJADI TERHADAP PIRANTI LUNAK MAUPUN PIRANTI KERAS ANDA DAN ATAS SEMUA KERUGIAN ATAU KERUSAKAN YANG DIDERITA OLEH ANDA ATAU PIHAK KETIGA LAINNYA, BAIK SECARA LANGSUNG, TIDAK LANGSUNG, SECARA TIDAK SENGAJA, KHUSUS, ATAU SEBAGAI SEBAB-AKIBAT DAN YANG TERJADI KARENA HAL LAINNYA SEBAGAI AKIBAT DARI AKSES ATAU PENGUNDUHAN ISI/MATERI KE PLAYSTATION®3 COMPUTER ENTERTAINMENT SYSTEM, PSP® SYSTEM ATAU PERANGKAT KERAS LAINNYA ATAU PENGGUNAAN ATAU AKSES TERHADAP PSN. ANDA BERTANGGUNG JAWAB ATAS BIAYA UNTUK PENYEDIA JASA INTERNET AND BIAYA LAINNYA YANG TERKAIT DENGAN PENGGUNAAN ANDA TERHADAP PSN, TERMASUK TERHADAP KENAIKAN BIAYA SEBAGAI AKIBAT DARI PENGGUNAAN PSN ANDA. SEMUA PEMBATASAN, PENGECUALIAN DAN PERNYATAAN DIATAS BERLAKU SECARA MAKSIMUM SEPANJANG HUKUM YANG BERLAKU MENGIZINKAN, BAHKAN APABILA PENGGANTIAN KERUGIAN APAPUN GAGAL MEMENUHI ESENSI DARI TUJUANNYA.
